PLEASE READ THESE TERMS CAREFULLY BEFORE USING PARKINSON’S AI. BY CREATING AN ACCOUNT, SUBMITTING YOUR EMAIL, OR USING ANY PART OF OUR SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SERVICE.

  1. WHO WE ARE AND WHAT WE OFFER

Parkinson’s AI (“we”, “us”, “our”, “Parkinly”) operates the website parkinly.co and provides an AI-powered health companion service delivered via WhatsApp (the “Service”). The Service is designed to help people living with Parkinson’s disease and their caregivers track symptoms, manage medications, follow therapy protocols, monitor wearable data, and access daily research summaries — all through a conversational AI interface on WhatsApp.

By using the Service you (“you”, “user”, “subscriber”) agree to these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated by reference.

  1. IMPORTANT MEDICAL DISCLAIMER

THE SERVICE IS NOT A MEDICAL DEVICE, MEDICAL TREATMENT, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

2.1 Parkinson’s AI is a wellness information and tracking tool only. Nothing the AI companion says constitutes medical advice, a medical diagnosis, a prescription, or a treatment recommendation.

2.2 Always consult a qualified healthcare professional — including your neurologist, general practitioner, physiotherapist, or pharmacist — before making any decisions about your health, medications, supplements, therapies, or exercise regimens.

2.3 Do not delay seeking professional medical advice, ignore your doctor’s instructions, or modify your medication based on anything the AI companion tells you.

2.4 In an emergency, call your local emergency services immediately. The Service is not designed for emergency use and should never be relied upon in a medical emergency.

2.5 The Dr Constantini B1 Thiamine therapy tracking module is an informational tracking tool only. We make no claims about the efficacy of any therapy, supplement, or protocol. Always follow the guidance of your own medical team.

  1. ELIGIBILITY

3.1 You must be at least 18 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

3.2 By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.

3.3 If you are using the Service on behalf of another person (for example, as a caregiver), you represent that you have the authority to accept these Terms on their behalf and that they are aware of and consent to your use of the Service in relation to their health data.

  1. ACCOUNTS AND REGISTRATION

4.1 To access the full Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials.

4.2 You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

4.3 You are responsible for all activity that occurs under your account. If you suspect unauthorised access to your account, you must notify us immediately at hello@parkinly.co.

4.4 We reserve the right to suspend or terminate your account if we believe your account information is inaccurate, if you breach these Terms, or if we suspect fraudulent or abusive activity.

  1. SUBSCRIPTION AND PAYMENT

5.1 The Service is offered on a monthly subscription basis at the price displayed at the time of sign-up (currently $9 per month). Prices are displayed in US dollars unless otherwise stated.

5.2 Your subscription begins on the date you complete payment and renews automatically on the same date each month unless you cancel before the renewal date.

5.3 Payment is processed securely by Stripe, Inc. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis. We do not store your full payment card details.

5.4 If a payment fails, we will notify you and may suspend access to the Service until payment is successfully processed. We may retry failed payments up to three times.

5.5 We reserve the right to change our pricing at any time. We will give you at least 30 days’ notice of any price change by email. Your continued use of the Service after the price change takes effect constitutes your acceptance of the new price.

5.6 All fees are exclusive of applicable taxes (such as VAT, GST, or sales tax), which may be added depending on your location and applicable law.

  1. FREE GUIDE AND LEAD CAPTURE

6.1 We offer a free downloadable guide (“the Guide”) to anyone who submits their email address via our website. By submitting your email, you consent to receiving the Guide and occasional email communications from us related to the Service.

6.2 You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us at hello@parkinly.co.

6.3 The Guide is provided for informational purposes only. It does not constitute medical advice and is subject to these Terms and our Privacy Policy.

  1. CANCELLATION AND REFUNDS

7.1 You may cancel your subscription at any time through your account settings or by contacting us at hello@parkinly.co. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until that date.

7.2 We do not offer refunds for partial months or unused subscription periods, except as required by applicable consumer protection law.

7.3 If you believe you have been charged in error, please contact us within 30 days of the charge at hello@parkinly.co and we will investigate promptly.

7.4 We reserve the right to offer a refund or credit at our discretion in exceptional circumstances.

  1. USE OF THE SERVICE

8.1 Permitted use. You may use the Service solely for your own personal, non-commercial health tracking and wellness purposes, or as a caregiver for another person with their consent.

8.2 Prohibited conduct. You agree not to:

— Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
— Attempt to gain unauthorised access to any part of the Service, our systems, or other users’ accounts.
— Reverse engineer, decompile, disassemble, or attempt to extract the source code of any part of the Service.
— Use automated tools, bots, scrapers, or scripts to interact with the Service except with our prior written consent.
— Misrepresent your identity or impersonate another person.
— Upload or transmit any content that is defamatory, offensive, harmful, or infringes any third-party rights.
— Use the Service in a way that could damage, disable, overburden, or impair our infrastructure.
— Resell, sublicense, or commercially exploit the Service or any data generated by it.
— Share your account credentials with third parties other than authorised caregivers within the Service.

8.3 WhatsApp usage. Use of the Service via WhatsApp is additionally subject to Meta’s Terms of Service and WhatsApp’s Terms of Service. We are not responsible for the availability, performance, or policies of WhatsApp or Meta.

  1. HEALTH DATA AND WEARABLE INTEGRATIONS

9.1 You may connect third-party wearable devices and health apps (including Garmin, Apple Health, Oura Ring, and others) to the Service. By doing so, you grant us permission to access and process the health data from those platforms as described in our Privacy Policy.

9.2 You are responsible for ensuring that you have the necessary rights and permissions to share data from connected devices and apps with us.

9.3 We are not responsible for the accuracy, completeness, or reliability of data provided by third-party wearable devices or health platforms. Health metrics derived from consumer wearables are estimates and should not be treated as clinical measurements.

9.4 You are responsible for the accuracy of any health information you manually input into the Service.

  1. CAREGIVER ACCESS

10.1 If you grant caregiver access to another person, you confirm that you have obtained their consent to view your health data and that you accept responsibility for managing that access.

10.2 Caregivers who access your data must not share it with any third party without your explicit consent.

10.3 You may revoke caregiver access at any time through your account settings.

  1. INTELLECTUAL PROPERTY

11.1 The Service, including its design, software, AI models, algorithms, content, and all associated intellectual property, is owned by Parkinly and its licensors. Nothing in these Terms transfers ownership of any intellectual property to you.

11.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal use in accordance with these Terms. This licence terminates immediately upon cancellation or termination of your account.

11.3 You retain ownership of any personal data and health information you submit to the Service. By submitting data, you grant us a limited licence to process and use that data solely to provide and improve the Service, as described in our Privacy Policy.

11.4 “Parkinson’s AI”, “Parkinly”, “parkinly.co”, and associated logos are our trademarks. You may not use them without our prior written consent.

  1. DISCLAIMER OF WARRANTIES

12.1 THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

12.2 We do not warrant that:
— the Service will be uninterrupted, error-free, or secure;
— any health information, insights, or research summaries provided will be accurate, complete, or up to date;
— the Service will meet your specific health or medical needs;
— results obtained from using the Service will be accurate or reliable.

12.3 We make no representations or warranties regarding the efficacy of any therapy, supplement, medication, or protocol mentioned or tracked within the Service, including the Dr Constantini B1 Thiamine protocol.

  1. LIMITATION OF LIABILITY

13.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARKINLY AND ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

13.2 THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, HEALTH OUTCOMES, LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.3 IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

13.4 Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so the above limitations may not apply to you in full.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Parkinly and its directors, employees, agents, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any health data or content you submit to the Service.

  1. THIRD-PARTY SERVICES AND LINKS

The Service may reference or integrate with third-party services, platforms, or websites (including WhatsApp, Garmin, Apple, Oura, Stripe, and Brevo). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their own terms and policies.

  1. SERVICE AVAILABILITY AND MODIFICATIONS

16.1 We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

16.2 We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.

16.3 We may update or improve the AI companion’s capabilities, responses, and features over time. Such changes may affect how the Service behaves and the nature of the insights provided.

  1. TERMINATION

17.1 You may terminate your account and subscription at any time by cancelling through your account settings or contacting hello@parkinly.co.

17.2 We may suspend or terminate your access to the Service immediately, without prior notice, if:
— you breach any provision of these Terms;
— we are required to do so by law;
— we reasonably believe your use of the Service poses a risk to other users, third parties, or us;
— your payment fails and cannot be resolved within a reasonable period.

17.3 Upon termination, your right to access the Service ceases immediately. We will handle your data in accordance with our Privacy Policy.

  1. GOVERNING LAW AND DISPUTES

18.1 These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Parkinly is registered, without regard to conflict of law principles.

18.2 If you have a dispute with us, we encourage you to contact us first at hello@parkinly.co so we can try to resolve it informally.

18.3 If informal resolution is not possible, disputes shall be submitted to the exclusive jurisdiction of the courts of the applicable governing jurisdiction.

18.4 If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

  1. CONSUMER RIGHTS

Nothing in these Terms is intended to limit any rights you may have as a consumer under the applicable laws of your country. Statutory consumer rights that cannot be excluded by contract continue to apply in full.

  1. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

  1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Parkinly regarding the Service and supersede all prior agreements, representations, or understandings, whether written or oral.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the “Last updated” date at the top of this page at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree to the updated Terms, you must cancel your subscription and stop using the Service.
